Acceptable User Policy

This Acceptable Use Policy (“AUP”) governs the use of Ark Networks LLC's services, including IP Connectivity, Colocation, IPv4 Leasing, CDN, and DDoS Protection (collectively, the “Services”). By using our Services, you agree to comply with this AUP.

1. PROHIBITED USES

You may not use Ark Networks’ Services for any unlawful, abusive, or harmful activities, including but not limited to:

1.1 Illegal Activities

  • Violating any applicable laws, regulations, or court orders.

  • Engaging in fraud, identity theft, or deceptive practices.

  • Unauthorized access to computer systems, networks, or data (hacking, phishing, etc.).

1.2 Intellectual Property Violations

  • Distributing, transmitting, or storing material that infringes copyrights, trademarks, patents, or other intellectual property rights.

  • Hosting or linking to pirated software, unauthorized media distribution, or counterfeit goods.

1.3 Network Abuse

  • Denial-of-Service (DoS) or Distributed Denial-of-Service (DDoS) attacks, whether inbound or outbound.

  • Port scanning, packet sniffing, or attempting to probe, scan, or test network vulnerabilities without authorization.

  • Traffic flooding, spamming, or excessive bandwidth consumption that negatively impacts other customers.

1.4 Email and Messaging Abuse

  • Sending unsolicited bulk emails (spam) or engaging in email harvesting.

  • Forging email headers, phishing, or impersonating another user or entity.

  • Sending malware, viruses, or other harmful code via email or messaging services.

1.5 Security Violations

  • Distributing malware, viruses, ransomware, spyware, or botnets.

  • Hosting or facilitating command-and-control servers for cyberattacks.

  • Engaging in activities that weaken or compromise the security of any system or network.

1.6 Inappropriate Content

  • Hosting, distributing, or promoting child sexual abuse material (CSAM), hate speech, or terrorist content.

  • Storing or transmitting material that is defamatory, obscene, violent, or encourages self-harm.

2. RESPONSIBILITIES OF CUSTOMERS

2.1 Customer Accountability

  • You are responsible for all activity associated with your Services, including activity by your employees, customers, or third parties using your account.

  • You must implement reasonable security measures to protect access to your systems and prevent unauthorized use.

2.2 Resale and Third-Party Use

  • If you resell Ark Networks' Services or provide access to third parties, you must ensure they comply with this AUP.

  • You are responsible for any AUP violations by your downstream customers or end users.

3. ENFORCEMENT AND REMEDIES

3.1 Investigation and Monitoring

Ark Networks reserves the right to investigate suspected violations of this AUP. We may:

  • Monitor network traffic and logs to detect abuse.

  • Request evidence of compliance from customers.

  • Cooperate with law enforcement in cases of criminal activity.

3.2 Actions for Violations

If we determine that a customer has violated this AUP, we may take any of the following actions, with or without notice:

  • Issue a warning requiring corrective action.

  • Temporarily suspend or restrict Services.

  • Terminate Services and revoke access to our network.

  • Report violations to law enforcement if required by law.

3.3 No Liability for Enforcement

Ark Networks is not liable for any damages resulting from actions taken to enforce this AUP, including service suspension or termination.

4. REPORTING VIOLATIONS

Include relevant details, such as logs, timestamps, and evidence of the alleged violation.

5. MODIFICATIONS TO AUP

Ark Networks may update this AUP at any time. Continued use of the Services after modifications constitutes acceptance of the new terms.
